When should my final pay be paid?

Under NZ law, your final pay must be paid on or before the pay day of the final pay period. This may be after your last day of work, but it cannot be delayed indefinitely.

What if I'm asked not to work my notice period?

Your employer can ask you not to work some or all of your notice period (sometimes called 'garden leave'), but they must still pay you for the full notice period unless you specifically agree to waive it. If you choose to leave early without your employer's agreement, you only get paid for the days you actually worked.

How is annual leave paid out in my final pay?

If you've worked less than 12 months, you get 8% of your gross earnings. If you've worked over 12 months, you get paid for any unused "entitled" leave at the higher of your ordinary or average weekly pay, plus 8% of your earnings since your last anniversary.

Am I entitled to be paid for public holidays after I leave?

Yes, if you have unused annual holidays you are entitled to. Your employer must treat these holidays as if you were taking them immediately after your last day. If a public holiday falls within this "extended" period, you must be paid for it.

Are alternative holidays (days in lieu) paid out?

Yes. Any unused alternative holidays must be paid out at your relevant daily pay (the amount you would have earned if you'd worked that day) on your last day, regardless of the rate of pay when you originally earned the day.

Is unused sick leave paid out in final pay?

No. By law, there is no legal entitlement for unused sick or bereavement leave to be paid out when you leave an employer, unless your employment agreement specifically requires it.

What if I think my final pay is wrong?

First, check with your employer to resolve any issues. If that doesn't work, you may have a claim for unpaid wages via the Labour Inspectorate. You can contact Employment New Zealand for help and mediation at 0800 20 90 20.
